# Terms of use

Welcome to the Gen8 platform. This document describes the terms of use \("Terms"\) that apply to your use of our services, including all associated software applications and technologies we provide. By accessing or using our services, you agree to these Terms. Please read them carefully.

## Definitions

- Gen8: The platform that integrates generative AI into business processes, provided by Gen8 VOF.
- Services: All features and services made available through Gen8, including API use, template builders and user interfaces.
- User: Anyone who accesses and uses Gen8's services.

## Registration and access

- Account creation: To use Gen8, you must create an account. You must provide current, complete and accurate information.
- Age requirement: You must be at least 18 years old to register an account, unless the law in your country allows you to give consent at a younger age with a parent or guardian's approval.
- Responsibility: You are responsible for all activities carried out under your account. Keep your login details private and secure.

## Use of our services

### Permitted use

- You may use our services for business and personal purposes, provided you comply with applicable law.
- You may build templates, customise workflows and implement API integrations as described in our functional documentation.

### Prohibited use

- You must not misuse the services, for example by engaging in illegal activities, stealing data or bypassing security measures.
- Using the services to distribute harmful or unlawful content is prohibited.

## Intellectual property and content

- Ownership of content: You retain ownership of all input you provide to the platform. Gen8 retains the right to use this content to improve its services.
- Output: You acquire ownership rights to the output generated from your input, subject to third-party rights.
- Use of intellectual property: Gen8 and its partners retain all rights relating to the software and services. You may use our trademarks only in accordance with our brand guidelines.

## Protection of personal data

- Gen8 processes your personal data in accordance with the GDPR. Details of data processing can be found in our [privacy policy](<https://gen8.app/en/privacy-policy/>).
- Your data is stored on secure servers, and we take reasonable measures to protect your information.

## Fees and payment

### Pricing

- Subscriptions: Use of some services may be subject to monthly or annual subscription fees. All fees are clearly communicated before purchase.
- Credit system: You may use a credit system for certain services or features within Gen8, such as API calls.

### Payment terms

- All payments exclude VAT and charges for additional services.
- In the event of non-payment, Gen8 reserves the right to suspend your access to the services.

## Termination and suspension

- Voluntary termination: You may close your account and stop using our services at any time.
- Suspension by Gen8: Gen8 may suspend or terminate your access if you breach these Terms, if required by law, or if risky or harmful activities are detected.

## Liability and indemnification

- Gen8 is not liable for indirect losses, such as loss of profit, data or goodwill. Our total liability is limited to the amount you paid us in the preceding 12 months.
- You indemnify Gen8 against all third-party claims arising from your use of the services or your breach of these Terms.

## Changes and updates

- Gen8 reserves the right to amend these Terms. Significant changes will be communicated at least 30 days in advance.
- We recommend checking these Terms regularly for updates.

## Dispute resolution

- In the event of a dispute, both parties agree to first attempt to settle it amicably before taking legal action.
- Disputes arising from these Terms will be heard by the competent courts in the Netherlands, unless applicable law requires otherwise.

## Final provisions

- If any provision of these Terms is invalid, the remaining provisions remain in force.
- These Terms constitute the entire agreement between you and Gen8 regarding the use of our platform.
